Terms of Service

1. Acceptance of terms

By accessing or using MiniMoods ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and MiniMoods. Please read them carefully before using our Service.

2. Account registration

To use MiniMoods, you must create an account. When registering, you agree to the following:

  • You must be at least 18 years old to create an account.
  • You may only create one account per person.
  • You must provide accurate and complete registration information.
  • You are responsible for keeping your login credentials secure.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you suspect unauthorised access to your account.

3. The service

MiniMoods is a child behaviour star chart application that allows parents and guardians to:

  • Create and manage behaviour charts for their children
  • Track positive behaviours and award stars
  • Record diary entries and mood observations
  • View progress and patterns over time

The Service is intended for personal, non-commercial use by parents and guardians.

4. Acceptable use

You agree not to use the Service to:

  • Engage in any illegal activity or violate any applicable laws or regulations.
  • Harass, abuse, threaten, or intimidate any person.
  • Upload or transmit any harmful, offensive, or inappropriate content.
  • Use automated systems, bots, scrapers, or other non-human means to access the Service without our prior written consent.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to gain unauthorised access to any part of the Service or its systems.

5. User content

You retain ownership of all content you create through the Service, including diary entries, behaviour definitions, star records, and any other data you input.

By using the Service, you grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing and improving the Service. This licence ends when you delete your content or your account.

You are responsible for the content you enter into the Service and confirm that it does not infringe the rights of any third party.

6. Children's information

MiniMoods allows parents and guardians to store information about their children. By entering children's information into the Service, you confirm that:

  • You are the parent or legal guardian of the child, or have legal authority to manage their data.
  • You are responsible for the accuracy of the information you provide about your children.
  • You understand and consent to the processing of your children's data as described in our Privacy Policy.

7. Intellectual property

The MiniMoods name, logo, branding, design, and source code are owned by MiniMoods and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

Nothing in these Terms grants you any right, title, or interest in the Service other than the right to use it in accordance with these Terms.

8. Service availability

The Service is provided on an "as is" and "as available" basis. While we aim to provide high availability, we do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

We may temporarily suspend the Service for maintenance, updates, or other operational reasons. Where possible, we will provide advance notice of planned downtime.

9. Limitation of liability

To the fullest extent permitted by the laws of England and Wales:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
  • Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim, or £100, whichever is greater.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless MiniMoods, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

Either party may terminate this agreement at any time:

  • You may close your account at any time through the app settings or by contacting us.
  • We may suspend or terminate your account if you breach these Terms, with notice where reasonably practicable.

Upon termination, your right to use the Service ceases immediately. You may request deletion of all your data, and we will comply within 30 days in accordance with our Privacy Policy.

12. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction over any disputes arising from or related to these Terms or your use of the Service.

13. Dispute resolution

If you have a dispute with us, we encourage you to contact us first at hello@minimoods.app so that we can try to resolve it informally. We will make reasonable efforts to resolve any dispute through good-faith negotiation.

If we cannot resolve the dispute informally within 30 days, either party may bring proceedings in the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Changes to terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email or through a prominent notice in the app at least 14 days before the changes take effect.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
